Agreement

By applying for membership of the Australian High Performance Program [HPP] as a member of the Australian Fencing Team [AFT] or the Australian Fencing Squad [AFS] and paying a nomination fee to the AFF, I agree to abide by the terms of this Agreement if I am accepted into the HPP by the Australian Fencing Federation [AFF]. This Agreement will take effect for the period identified in the High-Performance Annual Program [HPAP] which is included in this Agreement.

HPP members have access to the National Training Program including training camps and coaching with the AFF HPP coaching staff, access to the HPP Competition Program with the opportunity to represent Australia at the highest levels and as a member of the HPP there is the opportunity to pursue personal sponsorships, sporting scholarships and to benefit from any team sponsorships.

If I fail to comply with or breach   any term of this Agreement I agree that the AFF may impose such disciplinary measures or penalties on me as it deems appropriate and that such measures may include and  suspension or removal from the HPP.

Definitions

AFF Code of Conduct for Athletes means the code of conduct set out in Attachment B4 of the National Member Protection Policy issued and published by the AFF on its website from time to time.

AFF Policies means all of the policies and operational protocols of the AFF that are published on the AFF website including the AFF Member Protection Policy, Anti-Doping Policy, Communications (Athletes) Policy, Publicity Policy (and the FIE Publicity Code), AFF Selection Policy, Sponsorship Policy, Social Media Policy and Disciplinary Policy.

AFF Selection Policy means the policy issued and published by the AFF which policy explains how selections for the AFT and AFS and qualification for international competitions are made.

Agreement means this agreement including any annexures, addendums, schedules or variations to this agreement.

Assistant National Coach means any person appointed to the position of Assistant National Coach by the AFF and may hold that role from time to time.

High Performance Annual Program or HPAP means the training and competition program set by the High-Performance Commission and the National Weapon Coach which must be undertaken by me unless exemption in whole or in part is granted.

HPP Competition Program means the competition training sessions and competitions designated by the High-Performance Commission and the National Weapon Coach as part of the High-Performance Annual Program which must be attended by me unless exemption in whole or in part is granted under this Agreement.

International Events means individual and team events as set out for my High-Performance Annual Program.

National Weapon Coach means the national coach in charge of my weapon as appointed by the AFF from time to time.

National Training Program means the fencing training program designed for individual members of the AFT and AFS.

Personal Coach means the accredited coach nominated by me under clause 10 of section A.

State Fencing Association means the body responsible for the management and development of the sport of fencing in my State.

Tour Rules means the standing rules issued and published by the AFF that cover all AFF fencing tours.

Part A

In consideration of the AFF accepting me into the HPP I agree to:

  1. Pay the annual AFT/AFS Participation Fee of $1,560 (excluding GST) [the Fee], in twelve (12) equal monthly instalments to the AFF being $130 (excluding GST) per month.
  2. The amount will not be pro-rated if I join the HPP part way during the HPAP.
  3. Amongst other things, the AFF may apply the Fee against coach-travel to national and international competitions, camp fees (but not accommodation) and tour costs.
  4. Ensure that my capitation to the AFF through my State Association remains current.
  5. Ensure that I am an Australian citizen at all times during the term of this Agreement.
  6. Participate in any formal planning sessions arranged for me by the AFF.
  7. Undertake the High Performance Annual Program including individual training sessions, squad training, supplementary training, HPP training camps and HPP international training and/or competition tours as set out in the High Performance Annual Program.
  8. Make myself available to participate in International Events, and international training and/or competition tours as specified by the National Weapon Coach; as specified in the HPAP which is an annexure to this Agreement.
  9. Nominate for the events that require nomination under my High Performance Program and pursuant to the requirements and conditions of the AFF Selection Policy that are current as at the ranking date identified in any call for nominations for those events, acknowledging that there will be personal expense involved in participating in those events which is not covered under this Agreement.
  10. Pay all personal expenses (including travel and accommodation) involved in participating in the events, competitions, training camps, seminars and development sessions that are in my Annual High Performance Plan.
  11. Obtain prior approval from the National Weapon Coach to not participate in or vary part of the HPAP in a form determined by the AFF from time to time. Absence or non-participation in any part of the HPAP is a breach of this Agreement unless prior approval is given.
  12. Nominate a Personal Coach for individual training sessions who is a member of a State Fencing Association (or if not Australian based, a recognised by their National Federation) and who is accredited by the AFF, (unless they are a non-resident coach) or elect to have individual training sessions with the National Weapon Coach (if possible) or Assistant National Coach (if possible), and permit that coach to receive information about me as collected by the AFF.
  13. Respect the facilities and equipment of the AFF.
  14. Abide by the Tour Rules and avoid individual or collective behaviour which may reasonably be held by spectators or other fencers or officials or the AFF to be inappropriate for an elite athlete who is a member of the HPP.
  15. Keep my Personal Coach and my National Weapon Coach informed of any training conducted in my Personal Coach’s absence (for example, when travelling with the HPP or at training camp).
  16. Abide by the AFF Code of Conduct for Athletes and be bound by and comply with the terms of all AFF Policies.
  17. Supply a suitable photograph to the AFF for the purposes of promoting the HPP.
  18. Apply for and receive FIE licences that are valid for the term of this Agreement.
  19. Pay all invoices issued to me by the AFF within their credit terms.
  20. Supply accurate and current contact details, or (if I am a minor) accurate and current contact details of my legal guardian.
  21. Promptly attend to all AFF and HPP administrative processes and requests from AFF and HPP staff.
  22. Acknowledge that it may be necessary for the AFF to vary this Agreement and my High Performance Annual Plan.
  23. Be bound by any variations to this Agreement.
  24. Attend squads training in my state if it is a requirement of my High Performance Annual Plan.
  25. Pay all relevant fees and costs associated with state squads training to my State Fencing Association in addition to paying the Fee to the AFF. If, at any time, I am absent from state squads training, without exemption, I will still be liable to my State Fencing Association to pay for squad attendance fees.
  26. Consent to the AFF and its Member States sharing information about me including my personal information and my attendance at squads.

Part B

The AFF will provide me with the following:

  1. Access to the HPAP which includes the National Training Program including training camps and coaching with the HPP coaching staff.
  2. Access to the HPP Competition Program with the opportunity to represent Australia at the highest level as determined by the AFF Selection Policy and as required by this Agreement.
  3. Reasonable non monetary support, where requested, for pursuing personal and sporting scholarships.
  4. An opportunity to apply for any HPP sponsorships relevant to my status as a member of the AFT or the AFS.

Part C

If I withdraw from the HPP without the AFF’s approval or if this Agreement is terminated for non-performance, or for disciplinary reasons, I acknowledge that:

  1. the AFF may determine that I am ineligible to re-join the HPP (AFT or AFS), or to be entered into an event as an Australian representative, for a period of 12 months from the time I withdrew or terminated from the HPP.
  2. I will remain liable for all payments and fees that may arise under this Agreement including any outstanding amounts of the Fee.

Part D

If I withdraw from the HPP with approval or have a temporary absence approved, I acknowledge that:

  1. I will remain liable for payments and fees that may arise under this Agreement unless the AFF varies any fees owing in its sole and absolute discretion.

Part E

I have read the High Performance Annual Program and agree to undertake the program specified there or, if I have requested a variation, I agree to undertake the varied program agreed to by the AFF. I acknowledge that uploading a variation request does not mean that the AFF has agreed to any such request and that the AFF will process such requests on a case by case basis.

Part F

For the purposes of this Agreement:

  1. My acceptance into the HPP is determined by the Board of the AFF applying the AFF Selection Policy.

The undersigned hereby applies for membership in the HPP as a member of the AFT or the AFS and, if accepted into the HPP by the AFF, agrees to be bound by the terms of this Agreement.
